An opposition must be filed within two months from the publication date of the trademark application. No extensions are allowed for filing oppositions or counterstatements.
The opposition must be submitted in writing to the Trademark (TM) Registrar. The Opposition Committee notifies the applicant or their agent, providing a copy of the notice of opposition. The applicant has 60 days from the expiry of the publication period to submit a response (non-extendable). If the opponent submits an additional statement within one month of receiving the applicant’s counterstatement, the applicant is entitled to submit a final response within one month.
The Moroccan TM Office will rule on the opposition within six months, after reviewing the claims of both parties. If both parties wish to pursue an amicable agreement, the opposition procedures may be suspended for a fee of USD 350. The Opposition Committee's decision can be appealed before the Appeal Committee at the Trademarks Office within 15 days. The Appeal Committee’s ruling is final, but the opponent may initiate an invalidation action within three years before the Appeal Commercial Court of Casablanca. The total timeframe for an opposition case to reach a final decision is approximately 18 months.
