FAQs

1. What documents are required for renewing a trademark registration in Tunisia?

The following documents are required: A simply signed POA, which can be submitted within 30 days from the renewal application filing date. No late submission fees apply, and a high-quality scanned copy is sufficient. A general POA is acceptable. The number, date, and list of goods covered by the trademark registration. Simple copies of these documents are sufficient, and originals are not required.

2. What is the timeline and process for renewing a trademark registration?

A renewal application should be filed within six months before the expiration of the trademark’s protection period. A six-month grace period is allowed for late renewals, subject to a late fee. Due to a procedural shift at the Tunisian Trademark Office, a restoration request must now accompany late renewal applications, explaining the legitimate reason for the delay. No additional fees are incurred for this request. Under Articles 16 and 20 of the Tunisian Trademark Law, restoration is only possible within the six-month grace period following trademark expiration. Beyond this period, restoration requests will not be considered. The change of agent is automatically recorded when providing the POA for post-registration actions, at no cost. Additionally, it is possible to renew only certain classes within a multi-class registration while allowing others to lapse. However, a partial renunciation should be filed for the classes not being renewed.
