Trademark applications and registrations may be assigned with or without the goodwill of the business concerned. In the case of trademark applications, the publication will occur and the registration certificate will be issued in the name of the assignee. No financial consideration is required for the assignment. Additionally, partial assignment of a trademark is possible. The change of agent is automatically recorded when providing a POA for post-registration actions, at no cost.
The essential documents include: A POA from the assignee, which can be filed within 30 days of the recordal application filing date. No late submission fees apply, and the original document is not required. A deed of assignment, simply signed (without notarization or legalization), with a simple French translation. Simple copies of these documents suffice, and originals are not necessary. However, the Trademark Office may, in some cases, request the notarization of the deed of assignment, which will be processed accordingly if required by the registrar.
